MANILA, Philippines – The Bureau of Internal Revenue (BIR) has escalated its campaign against tax delinquency, filing criminal complaints against four taxpayers owing a combined P58.5 million. 

This aggressive move comes as the nation grapples with explosive allegations of systemic corruption in flood control projects, implicating high-profile figures, including former House Speaker Martin Romualdez and Ako Bicol Partylist Representative Zaldy Co.

While the BIR’s actions are presented as a routine enforcement of tax laws, the timing raises questions amidst the intensifying scrutiny of government expenditures and the alleged involvement of powerful political figures in fraudulent infrastructure schemes.

 The independent pursuit of tax evaders is a critical function, yet the broader context of massive alleged congressional and senatorial involvement in “ghost projects” casts a shadow, highlighting the urgent need for comprehensive accountability across all sectors.

The criminal complaints, filed with the Department of Justice (DOJ), target three corporations and one individual for willful failure to pay internal revenue taxes. The accused are:

Hamaya Philippines Corporation (Bacoor, Cavite)

P27.294 million in deficiency income and withholding taxes for 2017.

Annalyn Esteves Hara (Sorsogon)

P15.903 million in income and value-added taxes for 2017.

Antipas DT Construction and Development Corporation (Digos, Davao del Sur)

P9.661 million in various taxes for 2019.

SH Business Construction Services Inc.

P5.648 million in income and value-added taxes for 2017. This company became unreachable at its registered address, underscoring challenges in enforcement.

BIR Commissioner Charlito Martin R. Mendoza emphasized that tax liabilities are not absolved by ignoring official notices. He stated, “Once assessments become final and executory, the BIR is prepared to pursue appropriate legal remedies, including criminal action.” He urged taxpayers to promptly address BIR notices to prevent escalation.

These four cases contribute to the 78 criminal complaints filed under the BIR’s “Run After Tax Evaders (RATE)” Program since Commissioner Mendoza’s appointment six months ago. Conviction for willful tax evasion carries penalties of a fine of at least P10,000 and imprisonment between one and ten years, with additional penalties for responsible corporate officers.

The BIR’s steadfast pursuit of tax delinquents is a necessary component of good governance. However, the efficacy and fairness of such enforcement are magnified when viewed alongside the public outcry over alleged billions lost to corruption in critical infrastructure projects. 

The nation demands not only diligent tax collection but also rigorous investigation and prosecution of those who allegedly siphon public funds, ensuring that accountability extends to all levels of power.
