Malaysian High Court Blocks MOVE Travel’s Unauthorized Cebu Pacific Sales

MANILA, Philippines – In KUALA LUMPUR, Malaysia, the Malaysian High Court issued a sweeping injunction against MOVE Travel Sdn Bhd (“MOVE”), permanently barring the company from unauthorized use of the “CEBU PACIFIC” and “CEBGO” trademarks and the sale of flights bearing these protected brand names.

In a landmark ruling, the decision, handed down in June 2024, marks a significant victory for intellectual property rights and brand integrity within the competitive travel industry.

Cebu Pacific initiated legal action in the High Court of Malaya in Kuala Lumpur, asserting claims of “passing off” against MOVE. The airline contended that MOVE was illegally leveraging its established trademarks to distribute and offer flight tickets without authorization. Cebu Pacific stated that no agreement or permission was ever granted to MOVE.

The High Court’s judgment unequivocally sided with Cebu Pacific, finding MOVE liable for passing off. Crucially, the court granted an injunction that:

• Prohibits MOVE from using the “CEBU PACIFIC” and “CEBGO” trademarks.

• Restrains MOVE from distributing, offering for sale, or selling Cebu Pacific flights through its travel booking platform.

Furthermore, the High Court formally declared the “CEBU PACIFIC” and “CEBGO” trademarks as “well-known trademarks,” solidifying their protected status under the law.

Beyond the injunctive relief, MOVE has been ordered to pay RM120,000 in costs to Cebu Pacific. The court also awarded damages to Cebu Pacific, the precise amount of which will be determined in subsequent proceedings.

Cebu Pacific reiterated its commitment to collaborative partnerships, emphasizing that it continues to support authorized travel platforms and partners who legitimately use its trademarks and distribute its tickets with proper consent.

The airline also underscored the advantages of direct booking for passengers, advising that purchasing flights directly from Cebu Pacific ensures access to the lowest fares, the latest promotions, seamless booking management, immediate flight notifications, and a superior overall customer experience.
