This report, internally circulated in December, refers to Sarah as “V01” and details further alleged sexual touching at Khan’s home, office, and during overseas business trips – all reportedly non-consensual.

However, the path to accountability has been fraught with conflicting findings. In March, a separate report by an ICC-convened panel of judicial experts concluded there was “insufficient evidence to support a finding of misconduct measured against the standard of proof of beyond a reasonable doubt.” This panel deemed that the UN watchdog’s factual findings “do not establish misconduct or breach of duty.”

Adding another layer of complexity, The New York Times recently reported on yet another internal ICC report, which allegedly found Khan did commit sexual harassment and noted his initial equivocation regarding a sexual relationship before later attempting to dissuade Sarah from pursuing her claims. Khan, who has consistently denied the allegations through his lead counsel, Sareta Ashraph, maintains his innocence. Ashraph states, “These are serious allegations, and they need to be taken seriously, investigated thoroughly, and undergo a serious judicial review. And that is what has happened.” She added that the allegations “form part of a much larger body of evidence. Mr. Khan has denied and continues to deny them in their entirety – any form of sexual content, relationship, consensual or non-consensual, with the complainant.” Ashraph also argued that the UN OIOS report “does not have the same standing as the panel of judges” and “does not apply a standard of proof.”

Allegations of Escalating Non-Consensual Acts

Sarah’s interview with CNN provided chilling details of the alleged escalation. She recounted early interactions that instilled discomfort, evolving into more aggressive behaviors. These included Khan allegedly coming to her hotel room late at night and, on one occasion, pushing to join her for a “nap” and groping her down her leggings while she claims she feigned sleep.

Khan, in a previous interview with journalist Mehdi Hasan, denied any relationship with Sarah, stating he “completely denied engaging in any harassment, abuse of authority, or inappropriate behavior whatsoever.” He also cited tight security on overseas trips, claiming it would make unauthorized movements “virtually impossible.” However, Sarah refuted this, asserting that security measures did not restrict his movements.

The UN report details instances where Khan would allegedly check if Sarah was uncomfortable after such incidents. Sarah confirmed this to CNN but added, “If you know Mr. Khan, he’s not expecting a response from you – Mr. Khan does what he wants.”

Sarah also described extreme distress, at one point informing Khan that if the behaviors continued, she feared she would harm herself. Khan’s lead counsel stated no medical evidence was presented to OIOS regarding this allegation, and Khan does not recollect being informed of it.
