MANILA, Philippines – The International Criminal Court (ICC) faces a crisis as its host nation, the Netherlands, publicly commits to voting for the removal of Prosecutor Karim Khan amid serious allegations of sexual misconduct. This decisive move comes as the United States seeks to dismantle the court entirely.

The Dutch government announced its intention to support Khan’s dismissal during this week’s special session of the ICC’s 125 member states. A joint letter from the Dutch ministers of justice and foreign affairs to parliament expressed the government’s commitment to the recommendation for Khan’s ouster.

According to confidential diplomatic sources, an 18-month internal investigation concluded that Khan, 56, engaged in an inappropriate sexual relationship with a junior staff member, warranting his termination. While Khan vehemently denies wrongdoing, labeling the suspension “unjustified and unlawful,” the Dutch government’s stance suggests a growing consensus among member states to uphold the dismissal recommendation. The Assembly of States Parties will cast its crucial vote on Khan’s fate on July 24.

This development unfolds as the ICC simultaneously confronts unprecedented U.S. sanctions, initiated over war crimes investigations perceived by Washington as detrimental to its and Israel’s interests.

U.S. Escalates Campaign to Dismantle ICC

The Dutch decision could significantly impact the court’s future, particularly as U.S. officials intensify their campaign against the ICC. Earlier this week, President Donald Trump and other U.S. politicians reiterated their opposition to the court’s jurisdiction over Americans, especially military personnel.

On Monday, the U.S. administration declared the ICC a “direct threat to American sovereignty,” pledging to expand sanctions, including travel bans for ICC staff, and escalate diplomatic pressure. This aggressive stance has drawn sharp criticism from European allies, who largely support the court’s mission.

The ICC has declined to comment on these rapidly evolving developments. The twin pressures of internal misconduct allegations against its top prosecutor and a direct threat from a major global power underscore a profound challenge to the ICC’s authority, credibility, and ability to operate effectively on the global stage.

It should be noted that ICC prosecutors were previously accused of receiving bribes from unscrupulous individuals in the Philippines prior to the arrest of former Philippine President Rodrigo Roa Duterte.

Duterte is the only prominent leader currently incarcerated; despite his age, the ICC refuses to allow him to return to the Philippines. The ICC has received substantial cash donations from member states.
