MANILA, Philippines – In a move bolstering worker protection, the Department of Labor and Employment (DOLE) has affirmed private sector employees’ right to refuse work in the face of imminent danger from weather disturbances, without fear of administrative penalty. This crucial directive, enshrined in Labor Advisory No. 14, Series of 2026, signed by Labor Secretary Francis N. Tolentino on August 19, 2026, marks a significant update to existing guidelines, prioritizing worker safety amidst escalating climate challenges.

Empowering Workers, Protecting Lives

Labor Advisory No. 14, 2026, empowers workers by stating: “Workers who fail or refuse to work because of imminent danger resulting from such occurrences shall not be subject to any administrative sanction.” This provision is a safeguard, ensuring that employees are not forced to compromise their safety or health for fear of reprisal.

Employer Responsibilities and Prerogatives

The advisory clarifies employer responsibilities, emphasizing that “Employers may suspend work, as part of their management prerogative and in coordination with their safety and health committee, safety officer, or other responsible company officer, to protect workers from danger.” This highlights a proactive approach for companies to safeguard their workforce.

Compensation During Disruptions

Regarding compensation, the advisory stipulates that employees not reporting for work due to suspension are not entitled to regular pay unless stipulated by company policy, established practice, or collective bargaining agreements. However, employees may utilize accrued leave credits if permitted. For those who report and work at least six hours, full regular pay is mandated. Workers rendering less than six hours will receive a proportionate amount, with more favorable company policies taking precedence. DOLE encourages employers to provide additional incentives to those who report for duty during such challenging times.

This updated advisory, superseding Labor Advisory No. 15, Series of 2025, from November 26, 2025, is particularly pertinent given recent widespread weather disturbances and flooding across the country.
