SC Adopts “Victim-Survivor” in Sexual Violence Cases

MANILA, Philippines – The Supreme Court (SC) has officially adopted the term “victim-survivor” for individuals who have experienced sexual violence, acknowledging both the inflicted harm and their resilience.

In a decision affirming a man’s conviction for the rape of a 12-year-old, the Third Division, led by Associate Justice Japar B. Dimaampao, clarified this terminology. The minor testified to being sexually abused by her mother’s common-law partner since the age of nine, detailing a recent incident involving abduction, rape, and death threats. Fear of these threats prevented earlier reporting.

Both the Regional Trial Court and the Court of Appeals found the accused guilty beyond a reasonable doubt. The SC upheld this conviction, finding all elements of rape present and the accused positively identified.

The Court emphasized that “victim-survivor” recognizes “the harm and suffering inflicted while affirming the agency, resilience, and continuing dignity of those who survive such violence.”

The convicted man received a penalty of reclusion perpetua (up to 40 years in prison) and was ordered to pay PHP 450,000 in civil indemnity and damages to the victim-survivor.

Additionally, the SC directed the Department of Social Welfare and Development to refer the minor to a rape crisis center for comprehensive support, including psychological counseling, medical services, privacy and safety measures, family support, and recovery programs.
