MANILA, Philippines – The Philippine Supreme Court is set to transform the nation’s legal landscape with the official launch of electronic notarization (eNotarization) on October 19, 2026. This groundbreaking initiative will begin with the commissioning of the first cohort of qualified Electronic Notaries Public (ENPs), who will perform notarial acts under the newly enacted Rules on Electronic Notarization.

This significant leap into the digital age of legal services was solidified on February 4, 2025, when the Supreme Court, sitting en banc, approved the “Rules on Electronic Notarization” and the accompanying “Guidelines on the Accreditation of Electronic Notarization Facility Providers” (Resolution A.M. No. 24-10-14-SC). This monumental decision marks a decisive shift from traditional paper-based processes.

The genesis of this pivotal reform lies in the vulnerabilities exposed during the 2020 COVID-19 pandemic. Strict community quarantine measures halted traditional, in-person notarial acts, revealing the profound limitations of the existing “2004 Rules on Notarial Practice.” The legal community, facing unprecedented operational hurdles, urgently sought modern solutions.

In immediate response, the Court introduced the “2020 Interim Rules on Remote Notarization of Paper Documents” (RON Rules). While instrumental in maintaining legal continuity during lockdowns, this temporary measure underscored the inherent inefficiencies of paper-based notarization and highlighted the urgent need for a permanent digital framework.

Recognizing the global imperative for digitalization and the enduring benefits of remote processes, the Supreme Court established a high-level Technical Working Group (TWG). Chaired by Associate Justice Alfredo Benjamin S. Caguioa and co-chaired by Associate Justice Ramon Paul L. Hernando, the TWG was tasked with formulating robust rules for electronic notarial practice, defining essential technological specifications, and identifying cost-effective IT infrastructure. This formidable group, comprising diverse judicial representatives, demonstrated a unified commitment to modernization.

Building upon a foundational draft from the Court’s Subcommittee on E-Commerce under then Chief Justice Reynato S. Puno and a proposal from the U.P. Women’s Lawyer Circle, the TWG began its intensive drafting process in January 2021, navigating ongoing health protocols.

Leveraging insights and feedback from trial courts nationwide on the RON Rules’ implementation, the TWG meticulously refined its approach. Their initial draft of the “Rules on Electronic Notarization” was completed by November 8, 2021. Crucially, the TWG decided to supplement, rather than entirely replace, the 2004 Notarial Rules. This innovative hybrid approach ensures a seamless transition, facilitating immediate adoption of electronic notarization while guaranteeing the uninterrupted flow of legal affairs and daily notarial services.

The TWG’s unwavering commitment to innovation, a cornerstone of the Supreme Court’s Strategic Plan for Judicial Innovations 2022-2027, led to a groundbreaking expansion of territorial jurisdiction for electronic notaries public. After extensive historical legal review, the third version of the Rules, finalized on March 10, 2023, dramatically broadened this jurisdiction to serve individuals in remote areas of the Philippines and those abroad – a monumental leap forward in accessibility and global legal reach.

To ensure the new framework incorporated global best practices, the TWG conducted an in-depth survey of electronic notarization systems in countries like the United States, Australia, Indonesia, Japan, and South Korea. Identifying the U.S. framework as the most compatible and comprehensive, the TWG engaged directly with American legal firms and Secretaries of State offices in May 2023, gathering invaluable insights into implementation, best practices, and potential challenges.

A key learning from the U.S. experience revolved around the recognition of electronically notarized documents, particularly in real property conveyances. Proactively addressing this, Justice Caguioa and the secretariat met with representatives from the Land Registration Authority to ensure the seamless integration and recognition of electronic documents by registries of deeds, including discussions on necessary authentication technologies.

Crucially, the TWG opted for a system of accredited service providers rather than developing a singular, monolithic government facility. This strategic choice balances public interest protection with the promotion of innovation through competitive solutions, effectively avoiding the potential delays and resource intensiveness of a centralized system. Extensive consultations with various solutions providers in April and May 2023 confirmed the technological feasibility, security, and integrity of the envisioned electronic notarization framework.

After multiple rounds of internal discussions, expert consultations with stakeholders and solutions providers (who provided invaluable input on practical implementation), and incorporating feedback from the Court En Banc, the TWG finalized the “Rules on Electronic Notarization” and the “Guidelines on the Accreditation of Electronic Notarization Facility Providers.” The Court En Banc’s determination to retain the expanded jurisdiction of electronic notaries public, even in the face of potential international logistical challenges, underscores its profound commitment to removing hindrances and affirming the global validity of electronically notarized instruments.

This landmark resolution, born from foresight, collaborative effort, and an unyielding commitment to modernizing justice, signifies a pivotal moment for the Philippine legal landscape. It promises unprecedented accessibility, efficiency, and security in notarial services, confidently propelling the nation into a digitally empowered future.
