MANILA, Philippines – Senator Ronald “Bato” Dela Rosa, the former architect of the Philippines’ “war on drugs,” faces a confirmed International Criminal Court (ICC) arrest warrant, igniting a high-stakes standoff within the Philippine Senate. 

This development pits international judicial authority against legislative privilege, raising urgent questions about accountability for alleged crimes against humanity.

ICC spokesperson Oriane Maillet verified that Pre-Trial Chamber I issued a confidential arrest warrant against Dela Rosa on November 6, 2025, which has now been reclassified as ‘public.’ 

This triggered a dramatic sequence of events within the Senate on May 11, 2026. Dela Rosa, instrumental in a recent Senate leadership coup, was reportedly pursued by National Bureau of Investigation (NBI) operatives attempting to serve the warrant.

NBI’s Covert Operation and Senate’s Shield

Senate President Alan Peter Cayetano reported a troubling account from the Senate Sergeant-at-Arms, detailing a covert NBI operation. 

NBI National Capital Region chief Attorney Dong Gallo contacted the Sergeant-at-Arms at 7:00 AM, coordinating an intended arrest. However, Cayetano asserted, “they should have approached Senator Bato or the Sergeant-at-Arms with even a copy of the warrant and negotiated his surrender because they are on Senate premises.” Instead, Cayetano stated, NBI personnel “attempted to stop Senator Bato from attending the session.”

The warrant itself saw unusual handling. At 2:00 PM, a copy was presented to former Senate President Vicente Sotto III, who reportedly refused to allow its distribution. 

Hours later, the Senate, under Cayetano’s leadership, approved a motion to place Dela Rosa under its protective custody, shielding him from immediate arrest. 

Surveillance footage reportedly captured Dela Rosa evading NBI agents. A scuffle reportedly erupted between NBI agents and Senate personnel, prompting NBI Director Melvin Matibag to intervene.

Political Irony and Recalled Challenges

Opposition figures quickly commented on the situation. Mamamayang Liberal Party-list Rep. Leila de Lima, a critic of the drug war, admitted to finding humor in Dela Rosa evading NBI agents. 

De Lima also recalled Dela Rosa’s past challenge to former Senator Antonio Trillanes IV, daring Trillanes to personally handcuff him if an ICC arrest warrant materialized. Trillanes was reportedly present with NBI operatives. De Lima’s statement implicitly questioned Dela Rosa’s current stance: “Nasaan na ‘yung angas mo dati?” (Where is your swagger now?).

The confirmation of the ICC arrest warrant against Senator Dela Rosa marks a watershed moment in the Philippines’ reckoning with its “war on drugs.” 

It ignites complex questions about national sovereignty, the reach of international justice, and the accountability of high-ranking officials. 

As legal and political ramifications rapidly unfold, the world watches closely for the Philippine government’s response and whether Senator Dela Rosa will ultimately confront justice on the international stage.
